本年度は、(1)韓国出土木簡からみた百済律令の実態を解明し、日本律令との関係性を確認すること、(2)中国律令受容の視点から見た8～9世紀の新羅法律編纂の特質を見出すことに取り組んだ。(1)では、韓国全羅南道羅州伏岩里遺跡から出土した百済木簡の表記内容を検討し、木簡が徴税と関連して各戸の人丁と所有する耕作地の把握を目的として作成されたものであり、木簡に見える戸が各々ほぼ同じ規模であることを明らかにした。戸の規模が比較的均質になる傾向は律令制初期段階の日本戸籍に見える戸と類似しており、人民編成の面で日本律令に対する百済の影響をしてきた自らの主張をより明確にできた。(2)では、8～9世紀新羅における制度改変に関する史料を検討して、当該期は礼秩序と関連が深い律令の編目である儀制令・仮寧令・衣服令に該当する内容を、唐の法典から個別的に摂取していたことを明らかにした。7世紀後半までに中央集権的統治体制はある程度整備された一方で、8～9世紀は中国的礼制に基づいた制度の受容・整備に重点が置かれていたという新羅の唐制受容の傾向を把握するとともに、受容内容の傾向や法律編纂の形式が同時期の日本と類似することも指摘するものであり、8～9世紀の東アジアの共通性を見出している。礼制に着目することによって、人民編成に重点を置いていた昨年度までの研究を進展させることができたと言える。以上の成果のうち、(1)は史学会において、(2)は日韓文化交流基金日韓若手研究者交流会議において口頭発表している。

This year,(1) the interpretation of the actual state of the laws of Korea unearthed wooden slips, the confirmation of the relationship between the laws of Japan,(2) the viewpoint of the acceptance of the laws of China, the characteristics of the compilation of the laws of Silla in the 8th and 9th centuries, and the selection of groups. (1)However, the contents of the Baishi wooden slips unearthed at the remains of Fuyanri, Naju, Jeollanam-do, South Korea were examined. The wooden slips were made with the purpose of controlling the farming land for the purpose of characteristic tax and connection, and the wooden slips were found in all places, on the same scale. The scale of the law is relatively homogeneous, and the trend is similar to that of the Japanese law in the early stage. (2)The historical materials related to the reform of the system in Silla in the 8th and 9th centuries are discussed. The etiquette order and the catalogue of the laws and regulations in this period are discussed. The contents of the laws and regulations in Tang Dynasty are discussed. In the second half of the 7th century, the governance system of the central government was organized to a certain extent.
