International and Comparative Study on the Future Framework ofClimate Change

鉴于未来框架协议有必要明确气候变化法律的原则的含义，笔者向国际法协会提交了两份“气候变化法律原则”报告，其中也揭示了除“温室气体”以外的污染物，即气候变化条约没有规定的污染物，也具有温室效应。由于它们与跨界空气污染和臭氧层破坏密切相关，我向联合国国际法委员会提出并提交了一份报告，即气候变化问题必须更全面地纳入“大气层”保护的框架。

Since it is necessary for the future framework agreement to clarifymeanings of legal principles on climate change, I submitted two reports on “the LegalPrinciples relating to Climate Change” to the International Law Association (ILA).It alsorevealed that contaminants other than “greenhouse gases”, which are not regulated bytreaties on climate change, have greenhouse effects too. Since they are intimately related totransboundary air pollution and ozone depletion, I proposed and submitted preliminaryreport to the UN International Law Commission that the problem on climate change mustbe subsumed more comprehensivelyinto the framework of the protection of “atmosphere”.
