项目摘要

1)司法解剖をめぐる遺族への対応について過去に自研究の一環として行った司法解剖遺族への質問紙調査より、司法解剖時に警察官や法医学教室関係者からの遺族への対応に制度的な不備があることが示唆された。そこで、死因究明に係る遺族対応の発展的研究の一環として、司法解剖をめぐる遺族への司法関係者からの対応のあり方について検討することを目的として、従前から行なわれてきた行政・承諾を含めた法医解剖前後における関係者への対応の現状と、「診療行為に関連した死亡の調査分析モデル事業」における調整看護師の対応・支援を検討した。本検討から、司法解剖をめぐる関係者への対応のあり方について、特に直近で解決すべき問題点として司法解剖時の司法サイドの専任担当者の配置・育成並びにリーフレット等有形ツールの整備・配布が検討され、これら検討の一部は学術雑誌に掲載されている。2)法医学領域における人体由来試料の取扱い法医解剖時に採取する人体由来資料の管理や医学研究への利用といった取扱いについて、法的にも生命倫理上も共にルールが未整備であり、このことが法医学教室に多くの混乱をもたらしていることを感じた。そこで、法医学領域における人体由来試料をめぐる問題の実態を把握することだけでなく、将来的なルールの整備につながる議論をすることを目的として、全国の法医学教室を対象に、我が国初となる人体由来試料の管理取扱いに関する実態調査を行った。結果は学会発表を行ったほか、現在、論文を作成中である。また、この調査の前提となった、諸外国における人体由来試料の取扱いをめぐる問題と我が国の法医学領域での人体由来試料の取扱いについて総論的理解を図る論文を作成し、学術雑誌に掲載された。
