Taking apples as a case study, this project examined issues related to the management and protection of the plant variety holder rights (patents) and trademark rights that are essential for the application of intellectual property rights in the production and marketing of agricultural products. This is a new approach to the introduction of new plant varieties that is based upon trademark license agreements that are concluded to put these trademark rights into practice. The study focused on the Pink Lady (variety name : Cripps Pink) management system, the forerunner and the model of the “clubs” that have emerged in its wake.

本项目以苹果为例，研究了在农产品产销过程中应用知识产权所必需的植物品种权属（专利）和商标权的管理与保护问题。这是一种以商标许可协议为基础的引进新植物品种的新方法，这些协议是为了将这些商标权付诸实践而签订的。这项研究的重点是Pink Lady（品种名称：Cripps Pink）管理系统，它是随后出现的“俱乐部”的先驱和模式。
