Comparative Study of Therapeutic Jurisprudence as deconstruction of adversary system

“治疗性法学”是一种新的理念，它将诉讼程序视为一种为被告人提供解决问题途径的工具，而不是传统意义上的“对抗制”，将诉讼程序视为控辩双方之间的法律的较量。通过对这两个概念的分析，明确了两者的区别，以期通过实施治疗理念来革新日本的刑事司法。

"Therapeutic Jurisprudence" is a new concept that court proceeding is considered as a kind of tool providing the defendants problem solving way for their rehabilitation in stead of traditional concept, so called adversary system, which has been thought the proceeding as legal battle between prosecutor and defendant.In this research project, two concepts were analyzed and the difference was defined for renovating the Japanese criminal justice by implementing therapeutic ideas.
