项目摘要

表現活動の多様化・複雑化と、政府による表現規制の巧妙化、変質という表現活動を取り巻く現代的状況の下では、自由な表現活動の保障のための実効的な理論装置が考案されなければならない。こうした問題意識の下で、平成24年度は、前年度に引き続いて、アメリカ法との比較法を中心に、表現の自由に関する理論的な研究を行った。公表された研究成果としては、(1)アメリカ連邦最高裁による有害表現規制の司法審査の場面における表現の分類・カテゴリーに注目したカテゴリー審査の状況と意義をあきらかにした論考と、(2)国内法による国際的なレベルでの言論の自由の保障を志向した2010年「言論法」の内容を分析した論考がある。これらはいずれも、最新のアメリカ憲法学における判例、理論、制度に関わるものであり、比較法研究としての意義を有していると思われる。これらの研究を通じて、アメリカ憲法学の表現の自由理論は、理論的な変容の時期を迎えているということがあきらかにされた。日本憲法学にとって、内容規制に対する厳格審査を中心としたアメリカ連邦最高裁の表現の自由理論は、積極的に受容されるべきものとされてきている。一方のアメリカにおいては、言論保護的な性質を伴った判例や2010年「言論法」などの法制度が維持される一方で、裁判所による司法敬譲を求める「修正1条の制度主義」や、「保護されない言論」というカテゴリーを用いた、利益衡量と対置されうる分類的・カテゴリカルな方法論による表現の自由の保障を志向する判例理論が登場してきている。比較法を重視する日本憲法学においても、こうした変化をふまえた検討が今後必要であるということもあきらかにされたと思われる。
