本研究課題では、現代の我が国におけるポルノ規制の基本的な構図を示し、規制の有効性を検討することを目的に、特に都道府県青少年保護育成条例による有害図書規制を我が国における主要なポルノ規制であると位置づけ、文献収集と調査分析を行っている。具体的に、本年度は以下の3課題に引き続き取り組んだ :(1)これまで一元化されたリストがなく研究が困難であった、個別指定された全国の有害図書について、都道府県公報等を用いて有害図書リスト作成を行った。その結果、東京都、茨城県、大阪府、三重県の4自治体に関してはこれまで指定されたすべての図書をリスト化することができた。このリストは、今後有害図書関連の研究をする上で基礎データとして有用である。(2)前述の有害図書リストを利用して有害図書指定件数の推移を明らかにした。その上で、指定件数と出版点数や各種運動との関連を見いだそうとしたが、現在までのところ、有害図書指定件数の増減と関係のある要因は確かではない。(3)有害図書として指定された資料の内容分析を行った。その結果、特に性描写が原因となって指定された図書のうち特にコミックの場合、男性同性間の性交渉を描いた女性向けのボーイズラブならびに、異性間での性交渉を描いている女性向けのティーンズラブ、レディースコミックと呼ばれる図書に関しては、異性間での性交渉を描いている男性向けのものより性器などの描写が少ないにも関わらず指定されていることが明らかとなった。引き続き都道府県に対して引き続きインタビュー調査等を行っており、指定に恣意性がみられることに関して社会的・文化的側面と実務的側面の双方から原因を探っている。
