The constraints of the investor as a claimant in investment treaty arbitration.

本研究从“滥用”和“有效国籍”两个角度考察了投资条约仲裁中申请人的约束。基于“滥用”的索赔限制包括两种形式。第一个是与公司成立有关的滥用，以进行有问题的投资（滥用实质性权利），第二个是与提出索赔（滥用程序）有关。这里的重点是“滥用”的标准。有些标准在仲裁判例中有所体现，但没有明确的标准。因此，建议在国际投资条约仲裁中对申请人的限制使用明确的时间标准（关键日期）。关于“有效国籍”，有必要研究其与投资条约中“利益拒绝”条款的关系。

In this research, the constraints of the claimants in investment treaty arbitration was examined both from the point of view of the "abuse" and "effective nationality".Limitation of claimants on based of the "abuse" includes 2 forms. First one is the abuse relating to the incorporation of the company to make the investment in question (abuse of substantive right), and second, relating to raise a claim (abuse of process). The important point here is the criteria of "abuse". Some criteria are shown in the arbitration precedents, but there is no clear standard. Therefore, it is proposed to use of a clear standard of time (critical date) for constraints of claimants in international investment treaty arbitraion. About the "effective nationality", it is necessary to study the relation with the "denial of benefits" clause in investment treaty.
