本年度は、これまでに公表した私見の理論枠組みの検証作業として、裁判実務における責任能力の認定手法に焦点を合わせて研究を進めた。学説・実務ともに責任能力の判断基準としては、「精神の障害」（生物学的要素）と弁識・制御能力（心理学的要素）を併せて考慮する、混合的方法が前提とされている。しかし、裁判実務における責任能力の判断場面では、犯行当時の病状や犯行前の生活状態、犯行の動機・態様等が総合考慮されている。本研究は、こうした責任能力の認定手法が刑法理論上の要件と整合していないとの問題意識から、責任能力が争点となった裁判例の総合分析を試みた。その結果、裁判実務における総合的判断方法の下では、犯行当時の病状・精神状態を出発点としながらも、幻覚妄想（およびそれと密接に関係する動機の了解可能性）を軸に様々な要素が考慮され、各考慮要素は等価ではなく、最も重視される幻覚妄想（および動機の了解不能性）が認められるかどうかによって、他の事情の評価方法が変化する点が明らかとなった。もっとも、「精神の障害」および弁識・制御能力に関するわが国の通説的見解を前提とした場合には、認定手法と刑法理論上の要件の間に矛盾が生じることは避けられない。これに対して、私見の理論枠組みは、行為者の（合）理性に着目した形で弁識・制御能力要件を一元的に理解することにより、責任能力の重要な判断要素とされる「了解可能性」とも親和的な実体要件として心理学的要素が再構成され、「精神の障害」を心理学的要素の認定資料に位置づけることにより、犯行当時の病状・精神状態を総合的判断の一要素とする裁判実務の考え方とも整合性が図られていることを提示した。
