今年度はウォーレン・コート下に成立したプライバシー権を法的根拠とした1976年のカリフォルニア州自然死法を中心に研究した。カリフォルニア州自然死法は全米で初めて末期患者の生命維持装置の不使用または取り外しに関する指示書に法的権限を与えた。この法律を支えたのが、身体に関する決断の自由はプライバシー権によって保障されている、という考えであった。今年度の研究活動は主に修士論文の総括を中心に行った。修士論文ではカリフォルニア州自然死法と人間の尊厳のつながりを検討し、その研究成果を「死ぬ権利と人間の尊厳―カリフォルニア州自然死法を事例に―」という題目で4月の日本アメリカ史学会修士論文報告会で発表した。この報告は、カリフォルニア州自然死法をめぐる論争における「人間の尊厳」の概念に着目し、法律の賛成派と反対派が異なる尊厳の解釈を用いて議論を進めていたことを明らかにした。報告会では今後の研究につながるコメントをいただくことができた。また、当初の計画通り、『アメリカ太平洋研究』（査読有り）に投稿する論文（英語）を執筆することもできた。この論文ではカリフォルニア州自然死法の成立を可能にした1970年代のアメリカ社会に重点を置いて法律の意義を検討した。自然死法の成立には、医療技術の進歩や公権力に対抗したプライバシー権が大きな影響を与えたことを指摘した。今年度はカリフォルニア州自然死法とプライバシー権利のつながりを中心に研究を進めてきたため、最高裁判所のリベラル派判事の思想に関する二次文献の収集・分析はやや遅れている。しかし、カリフォルニア州自然死法を事例に研究を進めたことによってなぜプライバシー権が身体をめぐる問題の解決策として利用されたのか、なぜ文化的な価値観の衝突を調停するために法や裁判という公的な手段を用いたのか、という大きな問いについて考察することができた。
