项目摘要

研究最終年度である本年度は、明治期には日本が無国籍の予防規範を受容した一方で、同様の効果が戦後見られない現状を、国際要因と国内要因の視点から分析した。国際要因としては、第一に、国際社会における日本の地位が向上による、国際法を受容する必要性の、相対的低下が挙げられる。第二に、国際社会における無国籍の予防規範が、必ずしも重要視されておらず、日本においても無国籍の予防規範は政治的な重要性を帯びた規範とは認識されなかったことが挙げられる。国内要因としては、第一に、日本国内における無国籍者のインパクトが小さいことが挙げられる。第二に、明治以降日本人アイデンティティが強化されたことが挙げられる。上記の分析は、Asian Studies Association of Australia やスウェーデンのマルメ大学で実施されたRefugees, Borders and Membership Conference Membership Conference、グローバル・ガバナンス学会、国際法学会、日本国際政治学会等で発表を行った。アジア研究、移民・難民研究、国際法や国際政治の専門家からコメントをいただき、研究の質の向上を図った。また本年度は、無国籍の予防における国連難民高等弁務官事務所（UNHCR）と各国の果たす役割を実証的に分析した論文、日本における無戸籍者が選挙権を行使できない可能性を、法の文言の視点から分析した論文、戦時中の日本を例として、国籍の強制が人間の安全保障にとって重大な問題となりうることを分析した論文を執筆し、無国籍の予防規範の国際的地位や、日本における国籍や戸籍の役割を包括的に検討した。
