项目摘要

本研究の目的は、ルワンダ・ジェノサイド後の移行期正義が抱える課題と当事者の和解について、ローカルレベルでジェノサイドに関連する罪を裁いたガチャチャ裁判に焦点を当てて考察することである。そのための研究実施計画は以下の2点であった。(1)当事者の和解について現地調査で収集した情報と先行研究を突き合わせ、日本アフリカ学会で発表すること。(2)ルワンダのローカルレベルにおける移行期正義の課題を移行期正義研究に位置付け、日本国際政治学会で発表すること。このような研究目的と実施計画に照らした本年度の実績は、計画通り2つの学会で成果を発表し、さらに査読付き論文1本を執筆したことである。以下、成果の具体的内容を述べる。まず日本アフリカ学会では、ガチャチャ裁判で審理されたジェノサイドの窃盗罪および器物損壊罪の賠償において被害者が用いる「赦す」、そして加害者が用いる「赦しを求める」というルワンダ語に着目し、これらの言葉が賠償の交渉に用いられる事例を発表した。次に日本国際政治学会では、ジェノサイド後の移行期正義の課題を発表した。具体的には、国家が扇動したジェノサイドの責任を、扇動され加担した個人が負っている事例を示した。さらに査読付き論文では、現地での聞き取りおよび閲覧した裁判記録をもとにガチャチャ裁判閉廷後の当事者の和解について考察した。ガチャチャ裁判の先行研究には、当事者がいつかは心から赦し合えるという「道徳的な和解」を論じる研究と、ジェノサイド後の移行期正義が形骸化し当事者間の和解までには行き着かないと論じる研究がある。しかし申請者が現地で見てきたのは、同じ村に暮らすジェノサイドの当事者が互いに関係を断ち切らないよう見はからいながら賠償の交渉を行い、生活を営む実態である。このように関係を保とうとする当事者のやりとりから見えてくる実践を、「現実的な和解」と捉えた点に本研究の意義がある。

The purpose of this study is to investigate the transitional period of justice after the death of the victim and the reconciliation of the parties concerned. The following two points are included in the study plan. (1)The parties involved in the settlement of the dispute shall conduct on-site investigation, collect information, conduct advance research, conduct research, and submit reports to the Japan Institute of Civil and Political Science. (2)The topic of transitional justice was presented by the Japan Society for International Politics. This year's results are reported, and the results of this year's research are reported.
