项目摘要

本年度は、国民を支配する国家の道徳的権利についての研究を、とりわけ次の二つの側面から実施した。第一に、国家の道徳的権利を最もうまく説明できる立場を、異なる理論の比較検討を通じて明確化する研究を行なった。第二に、国家の支配権のそもそもの意味内容について、概念分析の手法を用いた研究を行なった。また、本年度の大部分にあたる2019年4月から2020年1月下旬にかけてアメリカ合衆国ブラウン大学哲学部に客員研究員として滞在し、現地の正統性および民主主義理論研究者と交流を深めつつ研究を行なった。上述の第一の研究については、現代政治理論の最先端の研究者の間で激しい論争状態にある「公共的理性リベラリズム」の立場の堅固な擁護論を展開した。この立場に対する決定的な論駁や擁護ができていなかった状況に鑑みれば、本研究は国家の権利についての先端的研究をさらに一歩前進させる意義を持つ。この研究成果については、2019年5月に政治思想学会で報告し、国内の優れた研究者と意見交換を行った。また、同一テーマの論文を学術雑誌に投稿し、査読の結果掲載可となった。上述の第二の研究については、法哲学で主に用いられる分析枠組みを応用し、国家の支配権の特定の解釈（権能構想）を擁護した。この支配権の解釈は、それ自体魅力的であるだけでなく、先述の「公共的理性リベラリズム」の議論とも連続的である点で、今後のさらなる理論的展開が期待できるものである。国家の支配権の正当化可能性は政治理論上の最も根本的な問題のひとつであるが、本研究はそのテーマに対する重要な学問的貢献とみなすことができる。この研究成果については、2020年2月にスイスのジュネーヴで開催された国際学会において報告を行い、国外の政治理論・法哲学研究者から有益なコメントを得た。

The possibility of the legitimacy of state control is the most fundamental problem in political theory. This study contributes to the important knowledge of state control. In February 2020, the research results were published by the International Society for Political Theory and Legal Philosophy.
