（１）「知的財産紛争に関する総合的研究」を課題とする本研究は、「イノベーションの促進において紛争解決が果たす役割は何か」という問いを立て、三つの論点を中枢に知的財産紛争が付託されるフォーラムを総合的に考察することを目的とする。二年目である２０２２年度は、研究課題としていた以下の二点について調査研究を進め、研究成果を発表する中で新たな課題の発見があった。（２）まず、第一の論点である規範の公開と秘匿の相克に関して仔細な検討を行い、これまでのEU・フランス・イギリスについての研究成果を元に日本法の調査を進め、特に調停と和解について一定の成果を得るに至った。1997年の工業所有権法学会においてADR活用の理念が論じられ、また2001年以降に調査研究が複数公刊されて以来、日本においては知財紛争のADR法制度について十分な学術的肉付けがされていないことが明らかとなり、制度論および立法論の提言へむけた研究を進めた。（３）続いて、第一の論点の派生的課題として経済学における紛争解決効率性に関する文献調査を促進した結果、法社会学の紛争理論に目を向けるに至った。紛争の社会的機能を巡る諸説（Simmel 1923; Coser 1956; Chiba 1980）を検証し、実定法の解釈論からは見えない新しい方法論の意義を見出し、先行研究調査を進めた。このことは同時に、第三の論点である知的財産紛争における専門法廷の機能についての考察に示唆を与えた。日本における法解釈論の議論、および近時の知財高裁機能論をめぐる先行研究を分析し、CJEUの裁判管轄及び裁判官の役割との比較研究への足がかりとなった。

(1) The purpose of this study is to investigate the promotion of dispute resolution and the results of dispute resolution. In 2022, the following two research topics were investigated and new research topics were developed. (2) The first argument is to discuss carefully the relationship between openness and secrecy, and to make progress in the investigation of Japanese law, to mediate and to reconcile certain achievements. Since 1997, the Industrial Property Law Society has been conducting research on ADR application since 2001. Since then, Japan has been conducting research on ADR law system, including the theory of intellectual property dispute, the theory of system and the theory of legislation. (3) The topic derived from the first argument is related to the dispute resolution rate in the field of sociology, the literature survey is related to the promotion result, and the dispute theory in the field of sociology of law is related to the goal. The function of conflict in society is discussed in various ways (Simmel 1923; Coser 1956; Chiba 1980). The third argument is that the property dispute is known, and the function of the court is investigated. The discussion of Japanese law interpretation, the analysis of the function of knowledge and finance in recent times, the comparative study of the jurisdiction and service of CJEU
