项目摘要

初年度は（１）二つの論考の発表、（２）実施予定調査の質問項目案の考案、および（３）Voluntary assisted dying（VAD、自発的な幇助死）の問題に関連し得る２つの他領域の課題についてパイロット的な調査を実施できた。まず（１）については医師による自発的積極的安楽死および自殺幇助を意味するVADに対する現代日本の主要な賛否両論を文献研究を用いて実施して明らかにし、BMC Medical Ethicsに発表することができた。賛成については患者の自己決定尊重、耐え難い苦痛からの救済など他の国々と共通する見解が認められた。他方、反対論についてはVADそのものに対する反対論、VAD法制化に対する反対論、そしてVADについて議論を開始すること自体に対する反対論が認められた。また本論ではVAD議論のために豪州Victoria州で実施されているVoluntary assisted dying Act 2017が議論の出発点になると論じた。さらに日本で優勢なVAD反対論に対して、規範倫理議論および実際にVADを様々な形で遂げた３名の人々の事例や発言を用いて反論を試み、その結果をClinical Ethicsに発表することができた。我々の反論には、VADを求める人々の「二重の苦しみ（double suffering）」の存在、個体としての個人の死と社会的死の差異、文化の可変性、他者への負担になることを理由とした希死の問題点、VAD反対論に生じ得る「滑りやすい坂」議論、そして、VADを求める人々に障害者差別や国家の優生思想の責任を負わせることの間違いが含まれた。（２）については意識調査に用いる質問項目候補として５０項目を作成した。（３）についてはVADに関わる意思決定に密接に関わる医師患者関係と、高齢一般市民のメンタルヘルスと終末期ケアに関する話し合いの現状について検討した。
