项目摘要

日本中近世の法の持つ構造を多角的に考察するという本研究の課題に基づいて、2023年度は研究会と史料調査を中心に検討を行った。研究協力者として大平祐一氏に参加いただいた。研究会は予定通り4回開催した（いずれもオンライン）。第1回（2022年11月）と第2回（同12月）はドイツのマックス・プランク研究所のワークショップ（Japanese Legal History Workshop）と併せて開催し、研究代表者の松園がThe concept of law in pre-modern Japan （前近代日本における法の概念）とThe world of law in the Muromachi and Sengoku periods （室町・戦国時代の法の世界）との題目で2回の報告を行い、日本・西欧・中国の比較法史の方法などをめぐって参加者と議論を行った。第3回（2023年1月）では近世の社会結合と紛争解決、第4回（同3月）では法制史学の形成とさまざまな学問交流がそれぞれ論じられた。また、史料調査は、近世後期に幕臣羽太正養が自らが目付・箱館奉行として関わった第一次蝦夷地上知と文化露寇について記録した『休明光記』を対象とした。開発論者でもあった羽太による蝦夷地への行政の拡張を知る手がかりとなる。2022年度は、まず原本が知られていない同書の書誌学的批判を行った。既知の諸写本の所在を確認、その上で写本の比較を行い、主に用いられてきた刊本テクストが系統の異なる複数写本によって作文されたものであることを明らかとした。テクスト比較を目的として史料画像の撮影委託を行ったほか、プロジェクト内で報告会を実施し、2023年度以降の検討課題を洗い出した。さらに前記の問題意識のもと、蝦夷地の行政史料を中心にリスト化と所在確認を行った。
