１９４９（昭和２４)年から１９９６(平成８)年までの旧優生保護法に基づく優生手術及び人工妊娠中絶に関するデータ（年別、都道府県別、理由別、男女別、年齢階層別）、同期間の群馬県における優生手術及び人工妊娠中絶に関するデータ（年別、理由別、男女別）、「ハンセン病問題に関する被害実態調査報告書」（２００５年 ハンセン病問題に関する検証会）、その他ハンセン病患者及びその配偶者に対して行われた優生手術及び人工妊娠中絶に関する文献を収集し、考察した。また、旧優生保護法に基づく優生手術に対する国家賠償請求訴訟では、旧優生保護法を違憲とする判決が相次いて出されており、これらの判決内容についても考察した。

The judgment is divided into two parts.
