令和４年度は、差別とは何か、といった点に関する基礎的研究を行った。近時、差別禁止法に関する基礎的・哲学的な研究成果が数多く公表されており、これらに関する文献研究に取り組んだ（Kasper Lippert Raumussen, Born Free and Equal?: Philosophical Inquiry into the Nature of Discrimination, OUP,2014; Tarunabh khaitan,A Theory of Discrimination Law, OUP, 2015など）。また、イギリス平等法に焦点を当てて、①間接差別と他の差別禁止行為（直接差別、関連差別、認識差別）の区分、②ポジティブ・アクションや障がい差別・宗教（信条）差別における合理的配慮との関係、③合理的理由の抗弁、④間接差別規制における比較対象決定の特徴、⑤直接差別と比較した、間接差別に対する救済の特徴、に関する文献研究を進めたが、とくに、①間接差別と直接差別の関係について検討を深めた。直接差別とは、差別禁止事由を理由とする差別的取り扱い（less favorable treatment）であるが、（ア）明確には差別禁止事由に基づいているとはいえない場合、（イ）使用者に差別的意図がない場合、にどう考えるべきかが問題となってきている。前者（ア）については、たとえば、移民労働を理由とする差別が人種を理由とする差別といえるのか、といった事案で問題となり、この点については差別禁止事由と実際の差別理由とが不可分に結び付いているかが問われることになる。また、後者（イ）については、意図を必要とする見方から客観的な理由を問題とする視点への移行がみられる。使用者に差別の意図がなかったとしても、客観的にみて明らかに差別禁止事由を理由とした差別的取り扱いである場合には直接差別に該当すると考えられてきている。令和４年度は、以上ような点について検討を加えた。
