本研究課題の理論的視座を確立するため、2022年度は先行研究のレビューに重点的に取り組んだ。特に、政策立案過程におけるフレーミングに影響を与える要因として、他国の政策が国境を超えて採用される現象、すなわち「政策の移転（policy transfer）」に焦点をあて、イノベーション政策、科学技術政策の文脈での移転促進要因と阻害要因を整理した。その結果、立法事由の根幹となるパラダイムシフトの発生が認識されている場合、または、立法事由への対処の選択肢がもたらす帰結に不確実性がある場合は、他国の政策が正統性の観点からも採用されやすいことが理論上予想された。一方で、産業政策としての側面がある場合、自国の競争力強化の観点からの考慮がなされることも予想され、例えば競合関係に陥る場合には、差別化のために他国の政策との差異化が図られる可能性も考えられた。これらの理論的整理と並行して、フェアユース規定をめぐる政治過程、及び、法解釈の動向について調査を進め、基礎的な情報を収集した。
