研究実績報告科研費で購入したコンピューターにより、知的財産権訴訟費用保険の研究に必要な国内・国外の文献・判例を現在データ化し、コンピューター入力を行っているところである。諸外国における訴訟費用保険一般や類似の知的財産権訴訟費用保険との比較研究を行っている。この点はとりわけアメリカにおけるCGL約款研究や判例研究といった形の研究を比較法雑誌に発表する予定である。また、我が国における各種の個別保険の中にある訴訟費用を填補する条項との比較研究を行っている。とりわけ各種の損害賠償責任保険、例えば、役員損害賠償責任保険や弁護士責任保険といった専門家の責任保険から、施設所有者賠償責任保険、請負業者賠償責任保険、生産物賠償責任保険といった企業の賠償責任保険などに見られる、訴訟費用保険条項の部分の比較研究を行っている。そこでいえることは、現在の各種の保険における訴訟費用填補制度には、必ずしも統一的・画一的名内容が見られないということである。これはそれぞれの保険の主たる目的が異なり、訴訟費用の填補は従たる位置づけがなされていることによるものである。しかし、そのような個別保険における訴訟費用条項における実務上の取り扱いと、先例ともいうべき判例は、まさに訴訟費用の填補のみを目的とする知的財産権訴訟費用保険約款においても参考にすべき内容を持っているといえる。具体的には、その保険で填補される訴訟費用と填補されない訴訟費用の区分けに、参考となる事例が多くある。この研究論文も作成中である。
