本研究は、婚姻における「妻の地位」と「妻の権利」をめぐる18世紀イングランドの男性たちの感情の動きから、近代フェミニズムの生成プロセスを明らかにすることを目的としている。初年度は18世紀の男性たちが離婚するにあたりどのように法を利用したのかを把握するためにイギリスの文書館で文献調査を行った。出張期間が限定されていたため、調査史料を二つに絞った。ひとつは、Parliamentary Archivesに所蔵されている議会離婚に関する史料である。18世紀の離婚は裕福な階層の夫たちに開かれていた。彼らの法をめぐる感情を明らかにするためには、同史料の調査が必須である。文書館では1日に閲覧できる史料の点数に制限があり、18世紀初期、中期、末期の事例数点に絞って調査を実施した。もうひとつは、教会裁判所史料である。離婚を成立させようとした夫たちは議会での手続きの前に、教会裁判所での訴訟手続きを踏んだ。今回の調査では、Lambeth Palace Libraryのアーチ裁判所史料、London Metropolitan Archivesのロンドン主教裁判所史料を調べた。上記の2種類の一次史料を読みながら、二次史料と比較し、18世紀の離婚手続きにおける夫側の法運用についておおよその知見を得ることができた。

This study aims to explore the relationship between the wife's status and the wife's benefits in the 18th century and the modern era.
