OTHER than three Fatimid and Mamliik documents published by Richard J. H. Gottheil 1, and a dozen or so Mamluik documents published by Noberto Risciani in a very elusive book2, few judicial records from the Muslim Middle Ages, i.e. prior to the Ottomans, have so far come to light. In consequence little is known about medieval Muslim judicial procedure3 other than what can be gleaned from literary sources, from adab and fiqh works on the one hand, which were intended to guide the qddi in his personal and professional life, and, on the other hand, historical works, be they chronicles or biographies, which record occasional data on the lives and activities of judges. As literary sources all these works have drawbacks, of course; the former because they seem to dwell on the ideal rather than the real, and the latter because they are filtered through the prism of the historian's choice and imagination. This being the case, the recent discovery of a cache of Islamic documents in the Haram al-Sharif in Jerusalem4 constitutes an important event in the study of the Islamic
