The significance of self-responsibility of the victim in the medico criminal law.

笔者主要从医生的责任问题和患者同意的有效性问题两方面考察了医学刑法中受害者（患者）自我责任的意义。近年来，假设协议问题在德国引起了广泛的关注，但这一法律原则在逻辑上是一个问题，在不同法系国家的我国似乎难以采用。此外，我考察了安乐死和基因研究中受害者自我决定的意义，并重申了受害者意愿在这一领域的重要性。

I examined the significance of self-responsibility of the victim (a patient) in the medico criminal law mainly on problems of the accountability of the doctor and the effectiveness of the consent of the patient. In recent years the problem of the hypothetic agreement attracts attention in Germany, but this principle of law is logically a problem and adoption seems to be difficult in our country which is different a law state. In addition, I examined the significance of the self-determination of the victim in euthanasia and the gene study and reaffirmed importance of the intention of the victim in this field.
