Innocence, Fairness and the Willingness to Accept Plea Bargain Offers

In contrast with the common assumption in the plea bargaining literature, we show fairness-related concerns systematically impact defendants' preferences and judgments, using both observational and experimental data. In the domain of preferences, innocents are less willing to accept plea offers (WTAP) than guilty defendants and defendants reject otherwise attractive offers that appear comparatively unfair. We also show that in the domain of judgment innocents exhibit more optimistic predictions of trial outcomes, and defendants who are uncertain of their culpability reject plea offers as if they are innocent. The article concludes by discussing the normative implications of these findings, including the cost paid by innocents collectively for their reluctance to plea, and showing these findings require both supporters and detractors of plea bargaining to reexamine some of their positions.
