Nutzung und Schutz der Meere unterliegen nach dem Seerechtsübereinkommen (SRÜ) der Vereinten Nationen (VN) je nach Meereszone unterschiedlichen Rechtsregimen. Der Anti-Verschmutzungsansatz reicht allein zur Erhaltung ihrer u. a. durch Überfischung und den Klimawandel bedrohten Funktionsfähigkeit nicht mehr aus; vielmehr ist ein ökosystemarer Ansatz (Ecosystem Approach, EA) anzuwenden. Das Projekt erfasst und analysiert völkerrechtliche und gemeinschaftsrechtliche Ökosystem-Ansätze im marinen Bereich mit Schwerpunkt auf der Seefischerei, ergänzt durch relevante „Soft-Law“-Elemente und die Staatenpraxis. Im globalen Völkerrecht wird das Zusammenspiel des SRÜ mit der Konvention über die biologische Vielfalt (CBD) vertieft untersucht, außerdem Übereinkommen und regionale Fischereiabkommen für Teile des Atlantiks und ausgewählter anderer Meeresregionen. Die Übereinkommen für den Nordostatlantik, die Ostsee und das Antarktis-Konventionssystem werden zum Vergleich herangezogen. In Europa liegt der Schwerpunkt der Analyse auf den Entwicklungen der Konventionssysteme für das Mittelmeer und das Schwarze Meer. Im Europäischen Unionsrecht werden naturschutzrechtliche Ansätze, die Gemeinsame Fischereipolitik und die Meeresstrategie-Rahmenrichtlinie untersucht. Die herausgearbeiteten Ergebnisse, Elemente und Instrumente eines kohärenten EA und ihre rechtliche Tragweite werden der Öffentlichkeit, der EU-Kommission, dem Europäischen Parlament und den Organen der Vereinten Nationen zur Verfügung gestellt.Conservation and utilisation of the oceans and seas are subjects to different legal regimes under UNCLOS. The anti-pollution approach alone is insufficient for the maintenance of ecosystem integrity endangered amongst other things by over-fishing and climate change. Therefore, an ecosystem approach (EA) should be adopted.The project comprises and analyses ecosystem approaches of the marine environment under International and European law with focus on marine fisheries, supplemented by soft law elements and state practice. On the global level of International law the interaction between UNCLOS and CBD will be analysed in greater detail, additionally treaties and regional fisheries conventions for parts of the Atlantic and other selected marine regions will also be included. The OSPAR Convention (North East Atlantic), Helsinki Convention (Baltic Sea) and the Antarctic Treaty System will be comparatively referred to.On the European level the focus is on analysing the developments of the Black and the Mediterranean Sea convention systems. Nature conservation law aspects, the Common Fisheries Policy and the Marine Strategy Framework Directive will be examined within European law.The identified and developed results, elements and instruments of a coherent EA and their legal range will be provided to the public, the EU Commission, the European Parliament and institutions of the United Nations.
