これまで公共空間の私化による集会の自由の行使可能性を扱ってきたが、当該自由の行使可能性への事実上の干渉をもたらす集会の監視の問題にまで検討対象を広げ、その序論的考察を行った。集会の自由への干渉は、近時「前域」にまで拡張しており、国家権力による監視措置のほか、集会参加を断念するような働きかけが増加している。こうした干渉から集会の場へのアクセスを十全に保障するべく、本年度はこうした干渉を講学上の「萎縮効果」と位置づけ、萎縮効果から自由な憲法上の権利行使を保障するための憲法審査の在り方につき序論的考察を行った。この序論的考察では、ドイツの憲法審査の段階である、それぞれ「保護領域」「介入」「正当化」という段階において、萎縮効果をどのように位置づけるのか、どのような従来の法理の修正が必要なのか、について検討した。まず「保護領域」においては、それぞれの憲法上の権利の保護領域には、それを行使するか否かについての決定の自由が存在しなければならないと示唆した。次に、「介入」では、萎縮効果のもたらす影響を捕捉するためには、従来の、間接的・事実上の干渉を排除する古典的介入概念の要件を修正する必要があることを指摘した。最後に、「正当化」段階では、萎縮効果がときに軽微であり容易に正当化され得ることから、より正当化のハードルを高めるべく「介入の加算」概念を導入することが考えられると結論づけた。以上の研究成果は論文として公表されている。

Second, the "intervention" is necessary to capture the impact of the "indirect" intervention. Finally, the concept of "intervention and addition" is introduced into the stage of "justification". The above research results are presented in this paper.
