项目摘要

2022年度は、2021年度に進めた奥田義人の身分法論の研究を踏まえた上で、今後の研究方針を再検討し、岡村司に関する先行研究などの調査に時間を用いたため、課題に関連する研究成果は発表出来なかった。これまでの研究で中心的に扱ってきた家産制度については、家制度維持のための制度と捉える見方と、小作農の保護のための社会政策立法であると捉える見方が大正8年の臨時法制審議会において存在したことが分かっており、研究方針を検討した結果、この家産制度の性質論について更に詳しく検討する余地があると考えた。即ち、今後は「家族法学の形成」の分析ではなく、研究課題を「家産制度論の展開」に絞り、家制度維持論の立場から家産制度の導入を検討した奥田や穂積重遠の言説、家制度廃止論者である岡村の家産制度や相続法に関する言説、そして戦前から戦時期にかけての社会立法としての家産制度論の特徴を整理し、時代や立場ごとに異なる同制度論の詳細を検討することとしたい。家産制度の探求は、個人の尊重を基礎とする現在の民法においては頽廃的議論のように思えるが、家の経済基盤を維持することが家族構成員の保護に資するとする穂積重遠の言説は、子どもの利益の尊重に立脚する今日の家族法解釈論においても傾聴に値するものであり、制度の当否を捨象しても、家族財産のあり方を考える上で重要な議論を提示するものと思われる。2023年度は、岡村に関する研究を行う予定である。近年では、岡村が法律関係を権力関係ではなく一元的に権利関係で捉えることを志向していたとする研究があり、こうした彼の根幹に存する法思想を踏まえた上で、その家族法論の位置づけや根拠を探求することが重要であると思慮する。
