项目摘要

2021年度および当該年度の研究の成果を中原茂樹「行政不服審査手続過程に関する一考察」大貫裕之ほか編『稲葉馨先生・亘理格先生古稀記念行政法理論の基層と先端』（信山社）373-391頁として公表し、以下の点を明らかにした。第1に、審理員および審査会の調査権限とは別に、審査庁に独自の調査権限が認められるかについて、少なくとも、審理員意見書または審査会答申と異なる内容の裁決が許容される限りで、必要な補充調査の権限が認められるほか、審査会からさらなる調査検討を求められた事項については、調査権限が認められると解される。ただし、審理員および審査会制度の趣旨を没却しないように留意すべきである。第2に、審査庁が審査会に対し、審理員意見書と異なる内容の諮問を行うことは、禁じられてはいないが、審理員制度の趣旨を没却しないよう、具体的理由を示した上で、審理員意見書の不十分な点についてのみ補充的に審査庁の見解を示すべきである。第3に、現行制度上、審査会は、裁決に至る過程において1回しか関与できないことから、あるべき裁決の内容を示すところまで調査検討が熟していない場合は、裁決の結論までは示さず、審査庁に対してさらなる調査検討を求める答申を行うことも可能と解される。第4に、裁決が審理員意見書および審査会答申を十分に踏まえて行われることを担保する仕組みにつき、裁決の内容の公表を徹底することを含め、検討すべきである。第5に、行政不服審査における職権探知の具体的なあり方につき、公正な手続や国民の権利利益の救済を図るという法の趣旨に留意しつつ、検討すべきである。第6に、処分の不当による取消しにつき、これを認めた裁決例を参照しつつ、さらに検討すべきである。第7に、特別の不服審査制度との合理的な役割分担や調整についても、審査会答申の付言等を参照して、検討を進めるべきである。
