项目摘要

本研究の目的は、国際組織の責任に関する国際法制度の現状を、理論および運用の双方から再検討することである。このために以下3つの具体的なテーマを設定する。第1に、国家間に適用される諸規則をモデルにした国際組織責任条文(以下ARIO)(特に、責任発生の要件、効果) それ自体の理論的根拠とその妥当性を考察する。第2に、国際組織を拘束し、違法/合法の判断基準となるルール(一次規則)の発展状況を検討する。第3に、責任を認定し、それを追及するための制度の発展とその国際法理論上の位置づけを探る。近年では、特に国際組織による人権侵害の被害者を救済する上で、国際組織ではなく、加盟国の責任を追及するという実行がしばしば見られる。また本研究は、裁判以外の代替的手段(オンブズマン等)を国際組織自体が提供し、そこで賠償や事実調査等を行う実行も視野に入れる。2022年度は、特に世界銀行という普遍的な国際組織の実行に注目しながら、前述第2、第3の点に関連する研究を進めた。まず、世界銀行を拘束する国際法上の規範に関連して、世界銀行内部の環境社会配慮基準の最新動向を分析した口頭報告を行った（日本国際経済法学会研究大会シンポジウム報告、アジア国際法学会日本協会国際法研究者・実務家研究会報告）。また、手続面に関する新たな発展として、世界銀行が2020年に設置した「アカウンタビリティ・メカニズム」について、従来の制度との比較や、国際法上の特徴を検討した英語および日本語の論文を発表した（武蔵野法学、OXIO）。世界銀行以外の国際組織について、世界保健機関（WHO）による国際保健規則（IHR）に基づく緊急事態宣言に関する実行を検討した論文も発表した（『国際秩序が揺らぐ時とき』）。

The purpose of this study is to discuss the responsibilities of international organizations, the current status of the international legal system, and the application of theory.このためにThe following 3つのspecific なテーマをsettingsする.
