本研究は国際社会における法秩序の特性を踏まえて、国家が独自に行う経済制裁に関する国際法規則の内実と外延を、理論的、かつ実証的に明らかにすることを目的とする。本研究が対象とする国際法規則は、具体的には、私人を標的にした経済制裁において、当該私人が国際人権法、越境刑法、通商法上、及び各国法上、いかなる射程において権利保障されるべきかを規律するものである。経済制裁は自国の外交政策を遂行するために柔軟な方法で実施される一方、安全保障に関わることであるために隣接する法領域では規律の例外とされることが多かった。しかし近年では経済関係の緊密化、複層化に伴い、経済制裁の適法性が問題になる局面が増加している。そこで本研究はこれまでの経済制裁の実証研究で十分に解明されてこなかった、経済制裁を規律する国際法と他領域との相互作用を中心的に分析することによって、グローバル化した国際社会における経済制裁の理論的基礎を提供することを目指す。1年目となる2021年度は、対象とする関係国が、どのような経済制裁を行い、それがどのような論理に基づき、どのような射程において行われてきたかを実証的に分析した。具体的には、各国法令の制定過程、その趣旨目的、制定を主導した国内の政治動態や社会的背景、制定後の運用過程、実施のメカニズム等を調査した。また、経済制裁と隣接領域との関連性も本研究の課題であり、デジタル貿易に関する研究を通じて本研究の課題も一部実施することができた。

This study focuses on the characteristics of the international legal order, the relationship between the state's independent implementation of sanctions, the internal extension of international law rules, the theoretical and practical aspects of sanctions, and the purpose of sanctions. This study focuses on the rules of international law, the specific aspects, the scope of sanctions, and the rules of international human rights law, cross-border criminal law, trade law, and national law. Sanctions are applied in a flexible manner in the execution of our foreign policy, and security is an exception to the rule of law. In recent years, there has been an increase in the number of issues related to the tightening and layering of economic relations and the legality of economic sanctions. This study is intended to provide a theoretical basis for the study of sanctions in the international community and to clarify the rules governing sanctions and the interaction between international law and other fields. In 2021, the analysis of the relationship between the country and the country was carried out. The specific aspects include the process of making laws in various countries, the purpose of making laws, the background of domestic political dynamics and society, the application process after making laws, and the implementation of laws. The research on the relationship between trade sanctions and neighboring fields is part of the research on trade sanctions.
