フーゴー・プロイスの法理論と政治・社会・歴史観察の連関を探り、彼の着想や世界観、論証構造の特徴を明らかにすることを目的とする本研究課題の遂行のため、二年目となる本年度は、主要な検討作業を進めた（その成果として公刊したのが、拙稿「第二帝政期におけるフーゴー・プロイスの法理論と政治・社会・歴史観察の連関（一）～（五・完）」国家学会雑誌135巻5=6号1頁以下、7=8号1頁以下、11=12号1頁以下（2022）、136巻1=2号45頁以下、3=4号59頁以下（2023）である）。本研究で着目したのは、プロイスがキャリアの最初期から呈示していた「発展」の観念である。政治・社会状況や歴史観察で用いるのみならず、彼の主著と目される教授資格申請論文においても、「発展史的考察方法」として法学方法論の柱となった。この「発展」の観念が、ベルリン市議当選前後において政治・経済構造の認識に活かされ、また、当時の「社会問題」を考察し全体的な見取り図を得るうえでも用いられていく。この過程で、彼の当時のドイツ政治・社会を把握する二項対立認識がくみ上げられるが、この背景に存在したのも、対立する利益が一時的に利益共同状態を形成して発展が進行するという、「発展」のイメージであった。以上示した内容は、プロイス内在的に読解を試みる本研究の一つの成果であると言える。プロイス研究は言うまでもなく蓄積が多く存在するが、法学論考や政治・社会・歴史評論は切り離されて論じられる傾向にあった。本研究は、両者をともに視野に収めたうえでその連関を探った試みであり、ここに意義がある。翌年度以降は、同時代の議論状況と比較検討することで、さらなる理解の深化を狙う予定である。
