项目摘要

金銭の支払いを命じる判決以上に、それ以外のことを命じる裁判、特に、一定の作為・不作為を命じる裁判の国境を越えての執行は困難を伴うことが多い。しかし、これまでの研究で明らかになったところでは、その困難性にかかわらず、外国裁判所の命じた非金銭裁判の承認・執行は実際に行われている（少なくとも、承認・執行を行う国々がある）。近年、2011年の国連指導原則などを受ける形で「ビジネスと人権」をめぐる考え方が国際的に普及するにしたがい、人権侵害（環境汚染等をも含む）に影響を与える多国籍企業等の活動の差止めを求める訴えなども見られるようになっており、従前からの典型的な知的財産権侵害、不正競争行為、名誉棄損行為等の差止めを求めるようなケースに限られず、より多様な類型の事件で非金銭的裁判による実効的救済が求められるようになりつつある。しかしながら、諸国の法制度は統一されているわけではないため、裁判を行った外国に存在する制度が、その承認・執行が求められる国には存在しないこともありえる。さらに、外国裁判所の判断が示されてから執行が求められる国での手続に至るまでには時間が経過するため、その間、事情の変更や法律関係の変動が生じることも考えられる。そこで、権利者に対する救済の実効的付与の観点からは、第１に、外国裁判所の下した非金銭的裁判の執行にあたり、その執行が求められる国の法制度に合うように外国裁判の「適応」を行うことが必要になりうる。第２に、外国裁判所による審理の対象になっていない事後的な事情変更や法律関係の変動を、執行を求められている国の手続の審理範囲に加え、場合によっては外国非金銭的裁判を「修正・変更」する形で、迅速に外国裁判を実効化することが求められうる。これら2点について、令和4年度までに限られた範囲ではあるが研究発表を行ったが、さらに研究を深める予定である。
