韓国における「子の出自を知る権利」と養子法―日本法の議論への示唆を踏まえて―

项目摘要

本研究では、日本と類似した課題を有する韓国の「子の出自を知る権利」と「養子法」に関する状況を検討し、考察を加えることで、我が国における「子の出自を知る権利」をめぐる議論に対してひとつの示唆を与えることを目的としている。上記の目的を達成するため、当該年度（令和4年度）は、前年度（令和3年度）に調査・分析した内容を研究成果（論文）として公表することに重点を置いた。具体的には、前年度（令和3年度）に行った文献調査や学会、研究会及び公開シンポジウムに参加することで得た知識、また専門家との意見交換会から得た知見をもとに、日本及び韓国における「子の出自を知る権利」に関する法的議論及び法制度の現状を整理・分析し、考察を加えた。考察にあたっては、まず、両国における「子の出自を知る権利」に関する現在の議論や法制度の状況を養子法との関連から整理した上で、韓国の関連する法制度に主な焦点を当てながら分析を行った。そして、当該分析をもとにした日本法と韓国法との比較を通じて、日本における養子の「出自を知る権利」をめぐる今後の検討課題を指摘し、考察を加えることに努めた。これらの研究成果は、本研究の今後の土台となるものであり、当該成果をもとにした研究のさらなる推進が期待できると考えている。また、当該年度（令和4年度）においては、これまでの研究内容を整理・公表するとともに、日本及び韓国の文献調査を通じた情報収集を進め、さらに様々な場面（親の離婚や再婚等）における「子の利益」等をテーマとした学会やシンポジウムにも積極的に参加し、専門家から知見を得ることにも努めた。とりわけ、「子の利益」を考慮すべき場面における「子の声を聴く」ことの重要性を再認識した。「子の出自を知る権利」のみならず、幅広い視点から「子の権利」及び「子の利益」に関する考察を深めていくにあたって、大変意義のある知見を得ることができた。

This study is similar to that of Japan and South Korea, and discusses the status of "child origin knowledge and benefit" and "child adoption law" in Korea. The above objectives were achieved in the current year (the fourth year) and the previous year (the third year), and the research results (papers) were highlighted in the report. In the past three years, we have conducted literature research, research, and publicity, and participated in the exchange of knowledge and opinions among experts. We have organized, analyzed, and investigated the discussion and current situation of the legal system related to the "child's knowledge and benefits" in Japan and Korea. To investigate the current situation of the legal system of the People's Republic of China and the relationship between the law of the People's Republic of China and the law of the People's Republic of Korea, and to analyze the main points of the legal system of the People's Republic of China. When this analysis is conducted, the Japanese law and the Korean law are compared. The results of this research are expected to be further developed in the future. In the current year (2010 - 2014), the research contents were sorted out, the public table was published, and the literature survey of Japan and South Korea was conducted. The information collection was advanced, and the situation (divorce, remarriage, etc.) was discussed. The "child benefit" was actively participated in, and the family knowledge was obtained. The importance of "children's interests" should be re-recognized. "The child comes from the knowledge of the benefits" and "the child's benefits" are closely related to the investigation.
