2021年度に得られた、検討対象Bの精査・分析・考察を進めていくにあたり、いわゆる学術論文・書籍だけではなく、特許庁の審判官等によるものなどを含めて、関連文献の収集・調査・分析を行った。収集にあたっては、検討対象Bに関する文献だけではなく、引用発明の認定、特許発明の認定、相違点等に関係すると思われる文献など、できるだけ範囲を広くすることを心掛けた。関連文献を調査した結果、同一案件において、特許庁と侵害裁判所で、引用発明と特許発明との相違点の認定に差がでた理由を検討しているものは、主に特許庁からの文献となるが、大まかにグループ分けすると、例えば、特許発明を表現する文言（請求項の文言）の解釈の違いによるとするもの（同様に、引用発明を記載している文献の文言の解釈の違いによるとするもの）、対象特許文献に明記されていない技術常識・技術水準のとらえ方に関する違いによるとするもの（同様に、引用発明に明記されていない技術常識・技術水準のとらえ方に関する違いによるとするもの）、引用発明の上位概念化・抽象化に起因する違いによるとするもの等が挙げられる。また、上記文言解釈や技術常識・技術水準のとらえ方について違いが生じた原因の一つとして、無効審判又は侵害裁判所の当事者の主張が異なることを指摘しているものもあった。これらの関係文献で得られた知見も参考に、2022年度は、検討対象Bの精査・分析・考察等をすすめていく。
