本研究の目的は、現在、ドイツで展開されている「排水賦課金」（Abwasserabgabe）の改革論議が、今日なお、伝統的な規制的手法との関係で排水賦課金という手法をどのように位置付けるべきか、という点に関心を寄せていることに着目して、改革のための検討の仕方や議論内容をわが国に紹介し、考察することにある。研究期間の２年度目にあたる2022年度においては、排水賦課金の改革論議に関する現在までの展開を明らかにするため、昨年度に引き続いて、ドイツ連邦環境庁の委託先研究会による2014年公表の鑑定意見書「排水賦課金の改革：更に発展すべき規律の選択肢、シナリオおよび影響」の分析・検討を進めるとともに、行政実務関連資料を含め、ドイツの環境法・環境法学に関する近年の文献・資料の収集と整理、およびそれらの精読を行った。排水賦課金制度の改革は、決してそれ自体が独自に行われているわけではなく、水域保全法制の中心的手法である水管理法上の規制的手法との整合性を図りつつ行われている。そこで2022年度においては、EU水枠組指令の採択およびドイツにおけるその国内法化に際して、水管理法のなかに「原因者負担原則」（Verursacherprinzip）が明記され、その具体化措置として経済的手法の導入が推奨されるようになったことが、排水賦課金制度の今後の改革にどのように作用するかを分析・検討するための文献・資料の収集と整理をあわせて行った。次年度は、前年度および本年度の研究を通じて集積を図ることができたこれらの研究の基礎資料をもとにして、分析・検討の総まとめを行い、研究成果の公表を進めていきたい。
