项目摘要

本研究は、ハワイ王国において制定された四つの憲法（「1840年憲法」「1852年憲法」「1864年憲法」「1887年憲法」）に着目し、「デモクラシー」をめぐるハワイ王国の対応を考察するものである。今年度は、①近年のハワイ史研究の動向把握、②「1840年憲法」制定以前のハワイの法的状況を考察した。①においては、(1)考古学と歴史学研究の融合をめざす研究、(2)宣教師の家族に焦点をあてた研究、(3)支配者と被支配者を二項対立的に捉えてきた従来のハワイ史研究に対して批判的立場をとる研究、といった新たなハワイ史研究の潮流を把握した。その上で、とりわけ(3)の研究視座が本研究に大きな示唆を与えることから、これに関連した先行研究の動向把握につとめた。(3)の研究は、いうなれば「新たなハワイ史観」とも言うべきもので、アメリカ人宣教師勢力がハワイ支配の唯一のファクターとみなしてきた従来の研究とは異なる立場をとる。すなわち、これらの研究は、18世紀末以降、欧米の多様な人々と多様な思想が交錯するハワイ王国で、ハワイアン支配者階級は王国の存続のために「選択的に」近代的法制度を取り入れた側面を強調する。この視座は、近代的憲法を制定したハワイ王国の意図をさぐる本研究においても、きわめて大きな問題といえる。②においては、アメリカの宣教師団がハワイに入植を開始した1820年代に、従来の口頭法と西洋から導入された成文法が並列していた実態を考察した。それによって、西洋の法の概念を導入したハワイ王国をとりまく複雑な社会状況が浮かび上がった。すなわち、この時期にハワイが捕鯨港として西洋人に利用される一方で、アメリカ人宣教師によるプロテスタンティズムがハワイ社会に浸透したのであり、急速に複雑化するハワイ社会の統合・統治を進めるために、ケースに応じて慣習的法と西洋的法が使い分けられていた可能性が浮かび上がった。
