项目摘要

昨年度に引き続き、投資条約仲裁と国内法および国内裁判所との間の関係に関わる1次資料と2次資料の分析を行った。本研究課題の中心的な問題の1つである、仲裁手続法レベルにおける国際法（投資条約）と国内法との間の交錯に関して、昨年度以来EU構成国間の投資条約（intra-EU IIAs）に基づく投資仲裁の可否の問題を検討してきた。本年は、この問題に関して史上初めて仲裁管轄の成立を否定した仲裁判断例（Green Power v. Spain, 16 June 2022）を分析し、ICSID条約に基づく投資仲裁と、投資条約と仲裁地国内法の双方に基礎を置く投資仲裁との間の法的な性質の差を再確認し、判例評釈として公表した。この問題をめぐって関連する他の事例も引き続きフォローした。また、同様に手続法レベルでの法の交錯に関し、国内裁判所が国際仲裁の差止めを命じる手続（いわゆるanti-arbitration injunction）の問題について資料の収集を行った。この種の手続は、近年ICSID条約仲裁に関しても申し立てられており、上で確認したICSID条約仲裁の自律性との関係で注目するべき事象である。各国国内法の内容も問題となるため、関連文献も含めて検討を進めている。さらに、世界的な「脱グローバル化」の流れの中で、国際経済法の「国内法化」も指摘されていることに鑑み、対内投資に対する投資受入国国内法による規律にも視野を広げ、論点の検討を行った。特に経済安全保障とサプライチェーン強靭化の動きから対内投資の規制と推進の国際法的整序が問題となると考えられ、通商法・投資法にまたがる検討が急務であることを国際学会にて口頭で報告した。

The relationship between domestic law and domestic courts was analyzed twice in the past year.
