研究3年目に当たる今年度は、昨年度に引き続き「考慮」の理論面について考察を重ねるとともに、本研究課題が対象とする家族法分野における考慮という方法の有用性を検討するための足掛かりとして、考慮という方法が有用性を示すと考えられるいくつかの具体例を広く探求した。まず、宗教規範の考慮が考えられる場面として、イスラム金融を巡る紛争の抵触法的処理方法について検討した。そこでは、国家裁判所においてある金融取引のシャリア適格性が争点となった場合、裁判所は、世俗裁判所によるイスラム法の適用可能性を否定して当該争点への判断を拒絶するのではなく、抵触法により指定される準拠法を適用する際、考慮の方法により、契約解釈の問題として、当事者の主張立証に基づくイスラム法を考慮しつつ、上記争点について判断すべきであると主張した。この研究成果については、日本語で公表するとともに（英語でも公表予定）、研究会及び国際シンポジウムにおいて発表した。また、準拠法以外の外国私法の考慮に関しては、企業グループ内部やサプライチェーン上での人権保障の実現へと向け、ヨーロッパ諸国を中心に制定されているいわゆる人権デュー・ディリジェンス法の抵触法上の取扱いについて検討した。そこでは、同法上の義務を負う対象企業を一方的に定める人権デュー・ディリジェンス法の規律方法と、双方主義的な準拠法選択の方法との不整合から、不法行為準拠法として人権デュー・ディリジェンス法が適用されない可能性があるところ、当事者の期待の尊重という観点から、準拠法として適用される法の適用の際に、人権デュー・ディリジェンス法上の義務を考慮する可能性について指摘した。この成果については、商業雑誌において公表しており、2023年度に開催の国際学会において報告することが決定している。
