项目摘要

私法上の不法行為責任制度は、社会の基幹技術となりつつある人工知能（AI）が係って発生する権益侵害に如何に対応することができるか。この課題につき、本研究では、不法行為訴訟における違法性要件の機能を肯定的に評価する立場から、特に2022年度には次の研究を行った。まず、21年度に引き続き、リベラリズム、コミュニタリアニズム、多文化主義、普遍主義等の政治思想や、資本主義や社会主義等の経済思想に関する西洋・東洋の研究を学際的に分析することで、それらの思想が日本民法学の価値判断・利益衡量に与える影響につき理論的な考察を行った。この考察は、生成（ジェネレーティブ）AIという、人間のコミュニケーション能力や創作能力に比肩し超克し得るものがいよいよ登場したこともあって、人間中心主義やヒューマニズムの再検討にも及んだ。以上の作業と並行して、次の三つの研究を行った。第一に、高度情報社会における民事上の監督義務者の責任（714条）の再構成のためにICTを活用する「見守りサービス」事業者の責任を論ずる研究において、709条の一般不法行為責任と714条の中間責任の役割を比較検討することで、709条の違法性要件の意義を再評価し、その論文を公表した。第二に、高度なAIによるビッグデータ分析によって社会的課題を解決する社会（データ駆動型社会）における民法（制度・理論）の意義を総論的に考察する研究において、不法行為訴訟制度の意義についても若干の検討を行い、その論文を公表した。第三に、生成AIによるプライバシー侵害の場面を念頭に、不法行為訴訟（特に違法性要件）がどのような役割を今後果たしうるかを検討する研究報告を行った。
