The state's access to corporate knowledge

知识是公共决策的基本要求。但能够生成此类知识的信息和能力主要由公司提供——尤其是在涉及风险决策的法律领域。因此，法律迫使这些私人组织产生必要的知识，并使公共当局能够分享这种企业知识（访问权限）。对此访问的分析基于两个例子：银行监管法中的风险管理和雇员保护法中的雇主责任保险协会。国家获取企业知识的法律安排、其理论理解及其宪法框架是该项目的目标。

Knowledge is an essential requirement for public decision-making. But the information and capacities which enable the generation of such knowledge are primarily available at companies - especially in areas of law dealing with risk decisions. Therefore these private organizations are forced by law to generate the necessary knowledge and to enable the public authorities to share this corporate knowledge(access). The analysis of this access is based on two examples: risk management in the banking supervisory law and employers' liability insurance association in employee protection law. The legal arrangements of the state's access to corporate knowledge, its theoretical comprehension and its constitutional framework are the objective of the project.
