项目摘要

本年度は、名古屋拠点において技術補佐員を雇用し、全国各地の行政不服審査会が認容答申を出した事例について、（必要に応じ）当該地方公共団体に対して情報提供の依頼または公文書開示請求を行うことによって、審査庁裁決書を入手する作業を行った。またこれと並行して、本科研研究の成果を取り纏めるべく、２回の全体会合を開催した。第１回全体会合（2022年９月５日）では、矢島聖也名古屋大学講師が「行政不服審査会の機能に関する論点と答申の整理・分析」、谷遼大北海道大学助教が「行政不服審査制度に関する論点と答申の分析」、林倖如台湾海洋大助理教授が「台湾における訴願制度の現状と改正動向」をテーマとしてそれぞれ報告を行い、その後、質疑応答を行った。第２回全体会合（2022年９月17日～18日）では、矢島講師、谷助教、林助理教授が第１回全体会合の補足的な報告を行ったほか、深澤龍一郎名古屋大学教授が「認容答申を受けた審査庁の対応について（2016～2020年度）」、曽和俊文関西学院大学名誉教授が「行政不服審査法の運用と課題－大阪府行政不服審査会での経験－」、張栄紅中京大学准教授が「中国における行政復議制度の改正動向」をテーマとしてそれぞれ報告を行い、その後、質疑応答を行った。以上２回の全体会合における報告と議論の内容を踏まえ、本科研研究の成果は、『行政法研究』第49号（信山社、2023年３月）の特集Ⅰ「行政不服審査法の意義と課題」に掲載された６つの論文として取り纏めることができた。
