项目摘要

本年度は、①災害補償制度が官民間でどのような異同をもって構築されているか、②そのような制度配置となった要因は何か、③官民間での制度の違いは「不均衡」と評価されるものでないか、④問題があるのであればこれを解消できる方法は何かについて検討を行い、博士論文としてまとめた(特にその第３章）。その概要は次のとおりである。・災害補償制度は、公務部門と民間部門でほぼ完全に別々に構築されており、官民間だけでなく、国と地方との間においても、基本原理上の大きな違いがみられる。特に、地方においては適用関係が複雑となり、理解が難しい状況が生み出されている。他方、別々に制度が構築されながらも、実体基準では、官民（さらに国・地方において）極めて近接した内容を持っている。給付水準の一部において「公務の特殊性」などが考慮される面はあるが、その上で比例的な取扱いの違いが実現しており、制度間の均衡が確保されているものと評価できる。・近接化をもたらす要因としては、a「官民均衡」「官公均衡」という指導原理が強く意識されている、b法の目的が官民で共有されている、c最終的な司法審査を担当する裁判所において災害補償制度を官民で区別する発想が見られない、d労災補償制度におけるいわゆる併存主義のもと、官民の共通基盤としての損害賠償原理が両制度の均衡を調整する機能を有している等を指摘できる。・しかしながら、手続面において官民間で大きな違いが存在しており、手続の違いが「不均衡」と評価しうる状況を生み出している。この問題性は地方の非正規公務員において顕著である。手続面で官民に違いが生じる要因は明確ではなく、それゆえ災害補償分野における労働関係法規の公務員への適用除外（官民の制度の関係性の当否）を評価する上では、手続上の取扱いの違いを十分に考慮する必要がある。その結果、立法論として、手続の改善の必要性が強く示唆される。

This is a problem for local non-regular civil servants. The main reasons for the occurrence of violations between the government and the people are clear, except for the application of laws and regulations on the relationship between the government and the people (whether or not the relationship between the government and the people is appropriate). The results of the legislation, the necessity of improving the law and the law are strongly expressed.
