项目摘要

2021年度は、各国の森林・林業行政を所管する政府機関で法律や行政文書を収集し、各国の「森林」の定義を比較して整理した。インドネシアでは、新たに制定された「森林管理法」が今後の森林管理に大きな影響を及ぼす可能性があることが分かった。社会林業に関する法令も改訂され、これまでジャワ島で林業公社プルフタニが管轄する国有林管理で「特別森林管理地域（KHDPK）」が設定されるなど大きな変化が起きていることを把握した。ベトナムでは、森林・林業の政策の最新情報・法令の収集した。また2021年が2021～2030年に関する「林業開発戦略」を策定する年に当たったため、これまで（2006年～2020年）の変化について分析を行い、2006～2010年（植林面積の拡大）、2011～2015年（持続可能な林業の概念構築）、2016～2020年（森林認証取得の拡大と付加価値の高い輸出製品のための木材生産）の特徴を明らかにした。インドでは、昨今の林野制度の動向を分析し、「森林」の定義および管理のあり方に司法が大きな影響を与えていることが明らかになった。1980年森林保全法には「森林」という用語に明確な定義がなかったものの、1996年の最高裁判所判決によって、一般的な「樹木が生育している土地」という意味での「森林」の解釈を適用し、保全の方向性が強化された。しかし、社会的実態を反映しない保全の強化は、草の根レベルの抗議活動を招き、実現が困難であることが示唆された。日本では、林野庁林業成長産業化モデル地域事業のモデル地域に選定された地域の「地域構想」を収集し、地域を主体とした森林経営の可能性を検討した。その結果、本事業は地域自らが地域固有の課題を認識し対応することを促す事業であることが評価されるとともに、事業運営のうえで地域内の各主体間の連携体制のあり方が重要であることが明らかになった。
