项目摘要

2022年3月25日に、海外共同研究先であるイタリアから帰国し、4月から日本でのフォローアップ研究を開始した。2019年6月7日に発効した欧州の「デジタル単一市場における著作権に関する指令（DSM著作権指令）」19条1項が規定する、著作者および実演家に対する「透明性の義務」に焦点をあて、①DSM著作権指令を受けて各会員国が行う立法および政策の動き、②「デジタル単一市場」を構築しようとする欧州にとってのDSM著作権指令の意義とインパクト、③欧州のコンテンツ市場の動向や指令の国内法化以降の各会員国内の動き、④多国籍オンラインプラットフォームの欧州域内におけるDSM著作権指令への対応や関連法制を検討していたが、その後の推移や政策立法の動向、各国での国内法化の状況を、オンライン学会や韓国出張にてフォローアップし、クリエイターへの正当な対価還元の前提となる「情報透明性」を比較法的に検討し、論文および学会発表を行った（研究成果は後述）。
