项目摘要

現在、コンテンツ利用許諾と使用料の徴収・配分の場面において、クリエイター（創作者）に正当な対価が還元されない問題が指摘されている。「使用料の徴収と配分の正確性と効率性」を果たすためには、著作権集中管理団体のほか、コンテンツ流通の関係者らが有する全ての著作権関連情報の透明性（transparency）が必要である。多くのコンテンツがオンラインプラットフォーム（online platform）で流通されているという現状で、プラットフォームの積極的な役割なしでは適切な対価還元は不可能である。本研究は、近時のEUデジタルサービス法（DSA）規則案をはじめとする欧米のオンラインプラットフォーム規制を検討し、クリエイターへの正当な対価還元のために開示されるべき情報とプラットフォームの役割を考察することで、クリエイターへの正当な対価還元のための法制のあり方を比較法的に研究するものである。2022年度はオンライン学会および海外現地調査（スペイン・中国・韓国）を行い、①オンラインプラットフォーム規制の現状、②クリエイターへの正当な対価還元のために、プラットフォームの透明性義務の対象に含まれるべき著作物関連情報は何か、③現行のプラットフォーム規制から変わるべき点は何かなど、デジタルプラットフォーム産業を規制する法制や政策に関する動向をヒアリングしてきた。その結果は研究成果として公表を予定している。
