项目摘要

本研究の目的は、実際に民事訴訟を利用した当事者に、その利用経験に関する評価を尋ねることにより、日本の民事訴訟手続に対する利用者の評価を明らかにし、民事訴訟制度が現に果たしている機能とその問題点を検証するとともに、そのさらなる改善を図るための経験・実証的な基礎を得ることにある。本研究は、(ⅰ)利用者調査の準備、(ⅱ)調査の実施、(ⅲ)調査結果の第1次分析報告書の作成、(ⅳ)調査結果の第2次分析報告書の作成の各段階からなるが、本年度においては、これらのうち、（ⅲ）の段階が中心となった。具体的には、2021年度に実施された調査の結果について、同年度末に作成された単純集計表及び基本的なクロス集計表を参照し、2006年調査、2011年調査、2016年調査の際に作成された一次分析報告書の記載にも留意しつつ、第1次分析報告書の取りまとめ作業を進めた。第1次分析の目的は、調査の結果をいち早く社会に伝える点にある。この段階では、特定の問題関心からの分析等に重点を置くのではなく、各種評価の現状とその変化を全体としてできるだけ正確に示すことが主目的となる。報告書の作成には、研究会における十分な討議を踏まえて行う必要があることから、月約1回のペースで研究会を実施し、研究会には、研究グループの構成員のほか、裁判官、弁護士それぞれ2名ずつの出席を得て、裁判実務に日常的に接する立場からの貴重なコメントを得ることができた。こうした作業の結果、2022年3月には最終的な報告書を取りまとめることができたので、現在、その刊行に向けた作業を行い、2023年度半ばには、書籍として刊行される予定である。

The purpose of this study is to find out the relationship between the parties involved in civil litigation and the users of civil litigation in Japan. For details, please refer to the results of the survey conducted in 2021, the pure set table and the basic set table prepared at the end of the same year, the records of the first analysis report prepared during the survey in 2006, the survey in 2011 and the survey in 2016, and the work of obtaining the first analysis report. The purpose of the first analysis is to investigate the results of the investigation. At this stage, the main purpose is to focus on specific issues such as concern and analysis, and to correctly present the current status and changes of various evaluations.
