本研究は開発途上国における製薬産業の知的財産権の在り方を、とりわけインド、バングラデシュ、ブラジルの3か国に注目して分析するものである。2021年度はインドを研究の１つの柱とした。インド研究：インドは、途上国ではあるが世界第3位の製薬産業を持つ。インドではジェネリック医薬品が市場の大部分を占めるが、一部大手の製薬企業は新薬開発にも着手している。このインドの製薬産業の新薬開発の動向と製薬関連特許の動向を特許データベースなどを使って分析した。データベースの分析から、インドの大手製薬企業は2005年以降、新規化合物のみならず、バイオ医薬品関連の物質特許も取得していることが示された。医薬品の開発には長期の年月が必要なため、インド発の新薬が上市に至った数はこれまで極めて限られているが、今後インド発の医薬品の上市も増加する可能性が示された。バングラデシュ研究：バングラデシュは後発開発途上国(LDC)の1か国であるが、LDCとして例外的に強い医薬品産業を持つ。この医薬品産業の急成長もあり、バングラデシュ経済は急速に成長を遂げ、2026年にLDCからの卒業することが決まった。卒業と同時にLDCゆえに享受している様々な優遇措置も失うことになる。同研究では、LDCからの卒業がバングラデシュの製薬産業へ与える影響をDWPIなど各種データベースを使って分析した。COVID-19関連研究：新型コロナウイルス蔓延をうけて、本研究でもCOVID-19を知的財産の取り扱いの視点から分析した。世界の医薬品企業や政府・研究機関の努力の成果が実り、新型コロナの治療薬およびCOVID-19ワクチンは短期間に開発された。しかしながらこれら治療薬やワクチンの配分の南北差は大きく、先進国でワクチン接種が急速に進む一方、低所得国のワクチン接種率は低くとどまっている。本研究では、治療薬やワクチンの南北差を是正するいくつかの取り組みを精査し、公平な分配を実現するメカニズムを提案した。
