本研究は、世界貿易機関（WTO）協定のうち物品貿易に関するルールを定めるGATTの安全保障例外条項（GATT第21条）の起草過程・過去の援用事例・紛争解決事例・主要国の解釈傾向等を分析し、国際経済法における安全保障例外規定の外延を明らかにすることを目的としている。採用第1年目である令和2（2020）年度は、主に起草過程・過去の援用事例・近年の紛争解決事例・主要国の解釈傾向等に関する一次資料及び二次資料の収集及び分析を行った。採用第2年目である令和3（2021）年度は、前年度の情報収集・分析活動を継続しつつ、GATT第21条を含む国際経済法における安全保障例外規定関連事例・判例研究を重点的に行った。2021年11月に本研究の一旦のまとめを行い、その成果を日本及び米国にて発表するとともに、実務家を含む国際経済法分野の専門家等に講評を求めた。講評内容を精査しつつ研究を更に進め、2022年3月に博士学位請求論文（英文）の形で結実させた。コロナ禍の中、採用初年度（令和2年度）当初に立てた研究計画を多少変更する必要は生じたが、オンラインでの資料収集や面会等を通じて、必要な情報収集及び意見聴取を行った。本研究の国際経済法における安全保障例外規定の外延を明らかにするという目的は未達成であるが、同規定の不確定性（indeterminacy）に着目することで、同規定の本質に迫る分析を行うことが出来たと考えている。

This study focuses on the drafting process, past use cases, dispute resolution cases, major country trends in resolution, etc. of the Safeguards Exception (Article XXI of the GATT) in the context of international trade organization (WTO) agreements related to trade in all goods, and the purpose of the Safeguards Exception (Article XXI of the GATT). Collection and analysis of primary and secondary data relating to the first and second year orders and the second year (2020), the drafting process, the use of past cases, the resolution of disputes in recent years, and the trend of resolution in major countries The second year of adoption and the third (2021) year of information collection and analysis activities in the previous year are included in Article XXI of the GATT. Examples of safety protection exceptions are included in the case study. In November 2021, the research was conducted in Japan and the United States, and the results were evaluated by experts including international experts. The content of the evaluation is carefully examined and the research is further improved. In March 2022, the doctoral degree request thesis (English) is completed. How many changes are needed to establish a research plan in the first year of operation (order and second year), and how many changes are needed to establish a communication, necessary information collection, and opinion acquisition plan. The purpose of this study is to analyze the nature of the security exception in international law.
