ドイツの法哲学者であったグスタフ・ラートブルフ（Gustav Radbruch, 1878-1949年）の理論は、第一次大戦後に大きな修正が加えられ、第二次大戦後にも一定の修正が加えられた。第一次大戦後には、合目的性と法的安定性の他に、平等の意味での正義（配分的正義と交換的正義）が法の理念として加えられた。第二次大戦後にはその平等の意味が形式的なものから実質的なものに修正された。この修正の経緯を探ることは、ラートブルフの思想の意義を明らかにするためだけでなく、法哲学の課題である「法とは何か」という問に対する探究にも示唆を与えるものである。ラートブルフの理論の修正の経緯を探るため、本研究では、まだ活字化されていない彼の手書きの講義草稿に着目している。この講義草稿は、1913年から1933年までの間に、ラートブルフが講義の準備のために作成したものであり、ハイデルベルク大学図書館に保存されてリいる。2022年度は、機械学習による自動翻刻ソフトウェアtranskribusを利用して講義草稿の活字化を試みた。現在も作業を続けているが、学習の作業に時間がかかり、人による翻刻よりは作業が進むものの、まだまだ使いこなせるレベルには達しなかった。今後も、transkribusによる翻刻作業を続ける予定である。なお、2022年度は上記作業と並行して、ラートブルフの法理念を継承しているロバート・アレクシー（Robet Alexy）の法理論の研究も進め、アレクシーの原理理論に関する論文を日本語とドイツ語で公表した。
