江戸の行政と法のあり方を示す史料を丹念に分析し、江戸の都市行政と法のあり方についてその新たな側面に光を当てることを計画している。そして、そのための具体的方法としては、江戸の都市法である町触とともに、特に行政法規や行政規則に焦点を当てて考察する予定である。そして、行政法規や行政規則の意義と重要性を確認するとともに、その際に町年寄、町与力、町役人等の実務役人が果たしていた役割について検証を加えることとしたい。いわゆる実務役人の具体的機能に関する問題も、これまでほとんど取り組まれてこなかった研究上極めて重要な課題である。町触とともに行政法規や行政規則等の内容とそれに対する実務役人の関わり方を具体的に明らかにすることができてこそ、都市行政と法の特質、さらにはその運用と施行のあり方の特徴を導き出すことができると考えるからである。周知のように、近世社会においては、行政、司法、立法が未分離な状況であった。そこで、本研究においては、近世における世界史的にも最大の都市である江戸における行政と法のあり方の問題に焦点をしぼりつつ、既に公刊されている「徳川禁令考」を中心とする史料集を再調査するとともに、東京を中心とする各図書館、公文書館等に所蔵されている膨大な数の「行政史料」を収集し分析することを目標とするものである。そして、以上の目的と方法による研究の遂行によって、同時期のヨーロッパ各国の都市研究に対しても、有用な情報を提供したい。
